ACTING top Kenya National Union of Teachers-KNUT officials have embarked on acts bordering on criminality and greed in order to be confirmed in office by the members in the coming AGM slated for the 08/06/2011. theweeklyvision has established.
theweeklyvision is however exclusively in possession of documents showing outright theft forgery and acts edging on criminal activity from some of the top officials fighting to be confirmed after acrimoniously taking over office.
First, the Acting Secretary General David Okuta Osiany who today is aged 59 according to an Identification report number 2146432897 from his Nyando District, it shows that he was born on 21st July 1952.
This report obtained from Tura Sub location in Ahero shows that this Identification card number 254804 was however handed to the registrar of persons on 3rd November 2000 for alteration on the pretext that it was destroyed.
Mr. Okuta’s Individual Number is 02548040 and as the report shows, the status of the ID as at 3rd August 2000 was destroyed and that it was to be re-issued.Funny enough, another type 4 Identification report number 2298173053 obtained three months ago shows that the Secretary General was issued with another card under the Modification of Civil Status, showing that he was born on 21st July 1955.
This government printed document shows Mr. Okuta’s home district as Nyando, Location as Kakola and clan as Kondhiro but alteration on his date of birth can not be ignored.
According to a former Registrar of persons in Nyanza, this criminal Act was obviously between the Ag. Secretary General Mr. Okuta and several clerks at the Nyando Offices a move he says was cleverly crafted to reduce the applicant’s age for political reasons.
“As far as we are concerned the details of the first ID reported as destroyed should be transferred to the new ID and no alterations as serious as the date of birth this is criminal” He told this journalist in his office in Kisii.
theweeklyvision also established that the first ID purported to have been “destroyed” was handed to the Clerks at the Nyando Offices by an Okuta agent with a note on the necessary alterations with emphasis on age.
As the polls to either confirm or reject the Acting officials draw near, teachers across the country will be keen to establish the integrity of the office bearers. It might as well be an uphill task for Mr. Lawrence Majali’s successor David Okuta to explain this discrepancy.
Records at the Registrar of Trade Unions obtained by this journalist shows that Mr. A .Osiany was aged 57 years as at 31st December 2008 while the ousted Secretary General Mr. Majali was 59 years old.
theweeklyvision has also established that the KNUT National Officials are also reeling from revelations that they have for sometimes now colluded with the Teachers Service Commission-TSC for double deductions in normal Union dues and social welfare as seen on most pay slips.Today, the Union has collected a total of Ksh 60 Million from teachers across the country illegally and it is this cash that it is suspected top officers have shared and are busy buying teachers across the branches to win confirmation.
Another top official whose bitter past has returned with an echo is the Acting National Treasurer Mr. Albanus P. Mutisya and his Assistant Richard Kibagendi Ngoge who could definitely find it difficult to be, leave alone seek confirmation.
If the KNUT constitution is to be followed, Mr. Mutisya should not hold national or branch office as he is tainted with a long history of dishonesty and corruption.During his days as the Machakos KNUT Executive Secretary in 2008, the branch offices were auctioned after he took a loan from Masaku Teachers Sacco and failed to pay it instead directing the Sacco to the National KNUT office to recover the money.
According to a certified report of inquiry into the affairs of the Sacco dated October/November 2008 and received by the Minister for Cooperative Development, Mutisya Member Number 2340, was “granted a loan of Ksh 700,000 in November 2004 recoverable at Ksh 280,000 per month for 24 months”.
The report prepared by Cooperative Auditor Vincent Nyongesa goes on to state that He got an additional of Ksh 400,000 and in 2005 October he was granted an emergency loan of Ksh 400,000 despite that he had an outstanding loan of Ksh 330,000.
In September 2006, he got another loan of Ksh 1.5 Million after applying for Ksh 1.7 Million. The report says Mr. Mutisia did not qualify for the loans if the rules were applied as he connived with society staff to engage creative accounting by using fraudulent journal vouchers that were raised to deposit his deposits by Ksh 137,000 as shown by a journal dated 7/7/2004 for A. Mutisya TSC 17801.
The report says “When we queried these journal entries, Mr. Mutisya brought some photocopies showing computations quoting cash receipts voucher number 16336 which we established was not a document from the Sacco”. The report that is today at the Minister Nyaga’s desk says Mr. Mutisya defaulted in loan re-payment from 2006 and his Fosa account had a mis-posted loan of Ksh 150,000 erroneously reducing the overdrawn balance by end of November 2008 much as he portrayed himself as a defender of the right of Masaku Teachers.
In a desperate move to recover Ksh 3.9 million shillings from Albanus Mutisya, the Masaku Sacco wrote a letter to the KNUT Secretary General in the hope that the matter could be settled. Little did they know that they were on a wild-goose-chase.
The letter with reference number MTSAC/GEN/VOL1/01/29/10/010 was dated 29th October 2010 and signed by the Chairman, Treasurer, Hon Secretary, and certified by the Supervisory Chairman, was received on 05 November at the KNUT head office.
The letter in our possession reads in part. “The above is one of the senior officials on the ground. He was granted loans by the society in 2006 and 2007 respectively. He has failed to pay even a single cent to service the same. When we notified his guarantors for attachment, he brought us a letter purportedly instructing the head office to pay his loan. However we have realized that the letter was never sent to your offices”.
After failure in communication, Masaku Sacco officials then sought the services of the courts at Machakos through B.M Mugata and Company Advocates then the court mandated Eastern Kenya Auctioneers to seize and sell any movable property of Mr. Albanus Mutisya’s KNUT Machakos branch office.
The property seized included a Toyota Saloon car Reg KAN 502V belonging to the KNUT branch. To date, the loan remains unpaid as Albanus seeks confirmation by the National Delegates conference in his current position.
The KNUT National Acting Assistant Treasurer Richard Kibagendi Ngoge is yet to recover from a separation case number 17 of 20099 at the Kisii Chief Magistrate’s court.
According top a certified plaint dated 1st July 2010, the Plaint Lucy Kerubo Ogoro alias Ngoge, who is Mr. Kibagendi’s wife. He is adulterous and has abandoned his matrimonial bed and home.
The plaint reads in part; “That Ksh. 75,000 was paid to my parents as marriage consideration consequent to the said marriage my husband moved away from the matrimonial home and went to stay at Nyamira”
The sworn plaint goes on to state how Mr. Kibagendi has abandoned home without reasonable cause abandoning Lucy without lawful excuse and even failing to attend re conciliatory meetings instead treating her with disdain, mental anguish and cruelty”.
This bloat could be huge for the Assistant Treasurer to shade off despite that he has put in place to ensure that he is confirmed by the teachers to take over National office.
Teachers across the country could not be aware of the double deduction which is a local arrangement between Mr. Osiany’s group and the TSC despite that it is clearly indicated on each teacher’s pay slips as Social Welfare remittance.
It would be interesting to see teachers go to the polls to elect office bearers putting in mind that the current office bearers are tainted in one way or another despite their preaching and exuding holiness.
