Two Nairobi based human rights activists Mr.Samson Owimba Ojiayo and Kiptoo Kipkorir John have drawn a petition that will be filed in the commercial court at Milimani in Nairobi against giant toilet paper manufacture Chandaria industries next week. The petition was prepared by a Nairobi based advocate. It is to be served on Mr. Darshan Chandaria and Mr. Bhakesh Shetty the managing director and production manager respectively. Kenya Bureau of Standards managing director has already been served.
Mr. Ojiayo and Mr. Kiptoo who describe themselves in court papers as human rights activists concerned with protecting, promoting and defending inherent human rights are accusing the manufacture of the toiletries of placing substandard product on the market.They are seeking orders to sop the manufacture from production until the matter is heard and determined by the courts.
In a case that could put Chanadria Industries out of business for a while, Mr. Ojiayo and his colleague contends that Kenyans have all along been getting a raw deal from a company that they have come to trust for so long. They contend in a petition seen by The Weekly Vision that they have established that for example the popular NICE & SOFT tissue paper, the indications on the label that it contains 4 rolls containing 200 sheets of 100mm x 125mm, but an actual physical verification of the sample revealed that each roll contains only an average of 180 sheets of 96mm x 115mm. That shows that for a roll of this brand of tissue paper sold by M/S Chandaria Industries Ltd the company defrauds and robs innocent consumers of 20 sheets and 4mm of tissue paper per roll. They go on to add that this may seem negligible but considering millions of people use this product daily and for many years, the company has been robbing its trusted customers of billions of shillings worth of shillings considering that Chandaria Industries was established and started operations in 1964.

They are seeking an order of prohibition directed at Chandaria Industries Ltd to stop production of their major products like TOILEX, DAWN PEKEE, NICE&SOFT, DAWN JUMBO and DAWN GREEN, pending hearing and determination of the case. They are also seeking orders directing the Kenya Bureau of Standards to inspect, confiscate all the substandard products of the company.
The petition says that if this honorable court does not intervene with urgency, Kenyans as consumers will continue to suffer loss as anticipated under article 35(2) of the constitution of Kenya.
