BUSINESSMAN POURS HIS FRUSTRATIONS IN COURT PLEADING FOR PAYMENT FOR GOODS SUPPLIED

Mzee Kunow Eden Ibrahim a native of Mandera County now settled in Kariobangi area of Nairobi since the 70s is a troubled man. Mr. Ibrahim’s troubles stem from the fact that one fellow business man, a man he trusted so much as to advance him goods on credit has turned out to be his main tormentor at his advanced age. He runs a wholesale shop deep within the sprawling Kariobangi area, selling various types of food items mainly for human consumption; he also owns various blocks of apartments within the area.

 The businessman who runs a bakery store within the same area Mr. Patrick Migwi Macharia has for a long time been one of Mzee Ibrahims biggest clients, buying goods worth hundreds of thousands of Kenya shillings and paying for them in cash, initially. In the cause of these business transactions, their relationship grew even bigger and at one stage, Mzee Ibrahim agreed to Macharia’s request to be supplied goods on credit.
Mzee Ibrahim supplied goods to Macharia on various dates totaling Ksh. 4,268,660.00; he then raised invoices for the goods which the recipient has declined to pay for. Instead Mr. Macharia drew a number of cheques which have been dishonored by the bank. That in itself is a criminal offense. Despite pleas from Mzee Ibrahim for the payments to be made Mr. Macharia failed to respond, Ibrahim had no choice but head to the courts.

Mzee Kunow Eden Ibrahim says in court papers criminal case no. 765 of 2015 seen by The weekly Vision that he together with his son Abdi Kunow trading under the name Banasa/Rueda stores dealt with and sold assorted goods as a whole seller situated in Kariobangi. That he supplied various types of goods to Mr. Macharia who has since failed to honor his pledge to pay for the goods. Banasa/Rueda Stores supplied various types of flour like Unga brand, Ndovu type, Baking flour, Dola and Sugar of various weights cooking oil to the Mr. Patrick Migwi Macharia trading as City Champion Bakers at agreed and reasonable prices on credit. The credit terms were that the Mr. Ibrahim would upon delivery of the goods to Mr. Macharia raise invoices and the payments was then expected to be made within an agreed period. 

Mr. Macharia at one stage pleaded with Mzee Ibrahim to withdraw the matter from the court corridors. The idea was for them that they find an amicable solution by settling matter out of court, a suggestion that was agreed to only for Macharia to renegade on the suggestion he had initiated.
